Photo Release Waiver Authorization and Release
For and in consideration of Dance Arts Pflugerville LLC (hereinafter "DAP") permitting the participant to enroll and participate in a dance/fitness/theatre training class(es), Participant by signing below, hereby voluntarily indemnifies, releases from liability, and holds harmless DAP, it’s staff, and the facility for any accident, injury, illness, death, loss, damage to person or property or other consequences suffered by Participant or any other person arising or resulting directly or indirectly from Participant’s participation in the dance/fitness/theatre training class(es). In the event that Participant is injured, Participant agrees to assume any financial obligation, either through Participant’s personal health insurance, or through some other means, for any medical costs which Participant incurs. DAP assumes no responsibility for any medical expenses, injury, or damage suffered by Participant in connection with the use of any
facilities or services in connection with the Activity.
IT IS THE INTENTION OF PARTICIPANT BY SIGNING BELOW TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON HIM/HERSELF, TO THE EXCLUSION OF DAP AND TO EXEMPT AND RELIEVE DAP FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH.
Participant further agrees that Participant, his/her spouse, assignees, heirs, guardians, and legal representatives will not make any claim against, sue or attach DAP for any loss or damage resulting from Participant’s participation in the Activity.
PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN FITNESS/DANCE ACTIVITIES. PARTICIPANT AGREES THAT THIS IS A RELEASE OF LIABILITY, A WAIVER OF THE PARTICIPANT’S LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH OR PROPERTY DAMAGE AND A CONTRACT BETWEEN PARTICIPANT AND DAP AND PARTICIPANT SIGNS IT OF HIS/HER OWN FREE WILL.

I agree that I may be videotaped, audio recorded and /or photographed during the class and that DAP may use and modify the images and /or recording for any and all uses, including but not limited to advertisement and marketing without any compensation and in perpetuity.

I agree that I may be videotaped, audio recorded and /or photographed during the class and that DAP may use and modify the images and /or recording for any and all uses, including but not limited to advertisement and marketing without any compensation and in perpetuity.

I hereby grant permission to the Erin Marie Akin-Thomas, Dance Arts Pflugerville LLC and it’s employees (hereinafter “DAP”), and its officers, trustees, employees, agents, students, representatives, successors, licensees and assigns (hereinafter "DAP") to photograph my image, likeness, or depiction and/or that of my minor children (if applicable). I hereby grant permission to DAP to edit, crop, or retouch such photographs, and waive any right to inspect the final photographs.
I hereby consent to and permit photographs of me and/or those of my minor children to be used by DAP worldwide for any purpose, including educational and advertisement purposes, and in any medium, including print and electronic. I understand that DAP may use such photographs with or without associating names thereto. I further waive any claim for compensation of any kind for DAP’s use or publication of photographs of me and/or those of my minor children (if applicable).
I hereby fully and forever discharge and release DAP from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness or image) arising out of the use or publication of photographs of me and/or those of my minor children (if applicable) by DAP, and covenant and agree not to sue or otherwise initiate legal proceedings against DAP for such use or publication on my own behalf or on behalf of my minor children. All grants of permission and consent, and all covenants, agreements and understandings contained herein are irrevocable.
I acknowledge and represent that I am over the age of 18, have read this entire document, that I understand its terms and provisions, and that I have signed it knowingly and voluntarily on behalf of myself and/or my minor children (if applicable).

Cancellation Policy
You must provide 24 hours notice to reschedule your session time, if you choose to cancel, you will then be issued with a credit to use within 3 months.

Session credits are not eligible for refund or transferable to other accounts.
​
If you are running late due to reasons beyond your control, get in touch with us by message or email and DAP will do their best to accommodate your sessions. If you are more than 15 minutes late to your booked sessions without getting in touch, the session will be considered forfeited.

Privacy Policy
Your email address, bank information, and personal contact information is never shared or sold to any other website or company. Information submitted in this page is only used for contact and business with DAP. Your phone number or contact information will never be sold to telemarketers or any other companies. All billing and contact from this company will have the name Dance Arts Pflugerville on it.
DAP does not keep billing information and uses third party hosts such as Stripe and Square to bill so we will never see your personal financial information or have access to sharing it with any other person. Your information is protected through these financial institutions.
No information of members of the DAP community or DAP community will be shared with any other individuals. All account information and medical conditions will be kept private between coach and client.
